These Space View Terms of Use (the "Terms") are entered into between Yibo Zhang (an individual developer, referred to below as "the Developer" or "we") and you (the "User"). Once concluded, the Terms have contractual effect between you and the Developer. Please read them carefully and make sure you understand all of them, particularly the passages shown in bold. By ticking or tapping "Agree", you are deemed to have read the Terms and to accept them. If you do not agree, please stop registering for or using our services immediately.
1. General
Space View is a tool operated by the Developer that provides information about spaceflight launches worldwide. It is delivered through the Space View WeChat Mini Program, the Space View app (iOS, Android and HarmonyOS), and the Space View application programming interface (API) and software development kit (SDK).
The Developer may amend these Terms from time to time as required by laws, regulations, national standards and the needs of the business. Where the Terms change, we will publish the updated version in Space View. Such changes do not constitute a breach of these Terms by the Developer. If you continue to use Space View after the Terms have been amended, you are deemed to have read, understood and accepted the amended Terms and to be bound by them; if you do not accept them, please stop using Space View immediately.
Any agreements, service rules, policies and notices concerning the products or services the Developer provides to you, whether already published or published in future, are supplementary to and form an integral part of these Terms and have the same legal effect. Please read them as they are issued. If part or all of a supplementary agreement is held invalid, that does not affect the validity of the other agreements or clauses.
Where these Terms conflict with an offline agreement you have signed with the Developer, or with the electronic order generated when you purchase a specific service, the offline agreement or the electronic order prevails.
2. Account Registration
Using Space View may require you to register an account or to sign in with a third-party account we recognise; otherwise we may decline to provide services to you.
Eligibility:
(1) registration is open to users worldwide;
(2) if you are an adult (18 or over), a legal person or another organisation, you must have full capacity for civil conduct;
(3) if you do not have full capacity for civil conduct, you must obtain your guardian's consent before registering for or using Space View. If you are a minor (under 18), the provisions of these Terms concerning use by minors also apply;
(4) if you do not meet any of the above conditions, please stop registering for or using our services immediately; otherwise the Developer may suspend or terminate your user status at any time.
Completing registration:
(1) you must provide true, complete and accurate information as prompted on the registration page. You may not register an account using another person's information or provide the Developer with any other false information;
(2) ownership of a Space View account rests with the Developer; on completing registration you obtain only the right to use the account.
Accuracy of information:
(1) if we find that you registered using false or inaccurate information, the Developer may, without notice, require correction within a specified period, delete data, restrict or suspend use, freeze or delete the account, and terminate some or all of the services provided to you;
(2) you should correct inaccurate information promptly and keep your information up to date and complete;
(3) if you fail to correct or update your information in time and the Developer is therefore unable to provide services as agreed, or you suffer loss in the course of using the Developer's products or services, you bear that loss yourself;
(4) the Developer bears no liability for suspension or termination of service arising from the above, and you bear all adverse consequences. If the Developer suffers loss as a result, you are liable accordingly.
3. Account Security and Rules of Use
You must keep your account, password and other valid identifying information safe. You bear all loss arising from disclosure or loss of your account, password or other identifying information, or from theft or alteration of your account and password, where this is due to reasons attributable to you. You are responsible for everything done using your account and password, and the Developer bears no liability for it.
If you discover that your account or password has been misappropriated or used by someone else, notify the Developer immediately by an effective means and ask us to suspend the service. The Developer is not liable for your loss during the reasonable period it takes to act.
You may not transfer, sell, rent, lend or share your account, password or any part of the rights attached to your account. If doing so infringes or may infringe the Developer's lawful rights and interests, or the personal information, privacy or other lawful rights and interests of a third party, the Developer may restrict, freeze or delete your account without notice and suspend or terminate some or all services under these Terms, without liability.
Any information scanned, uploaded, created or shared through your account, and any action taken through it, is treated as your own act, and you are fully responsible for everything that happens under that account.
If you cancel your mobile number, or it is cancelled for any other reason, please update the number linked to your Space View account promptly. The Developer is not liable for leakage of user data or other harm to your interests caused by your failure to do so.
If you fail to comply with these Terms when publishing information in Space View, we may — to protect the reputation, standing and security of Space View — delete the information concerned, and may go as far as closing your account and/or temporarily or permanently prohibiting you from publishing in Space View. We reserve the right to pursue your legal liability, and our system records may serve as evidence of your breach of the law or of these Terms.
If, without permission, you obtain information, content or data from Space View unreasonably and in bulk — including by maliciously registering accounts, or by machine scraping, copying or mirroring — our systems may automatically close your account without any liability to you. Where several accounts from the same IP address repeatedly do so, we may automatically block that IP address without any liability to you.
4. Rules for Using the Software and Services
The Developer grants you a non-transferable, revocable and non-exclusive licence to use our software and services. Unless otherwise agreed in writing, you may install, use and run our software and services on the relevant devices for non-commercial purposes only. You may not transfer the rights or information under these Terms to any third party for commercial purposes.
You may obtain our software from the Developer's official channels or from a third party authorised by the Developer. If you obtain our software, or an installer bearing the same name, from a third party that the Developer has not authorised, we cannot guarantee that it will work properly and we are not responsible for any resulting loss.
Please use Space View correctly. For how specific features work, see the help content under "Mine → Contact Support" in the app. If that does not answer your question, contact us directly at kefu@bincare.cn. You bear any loss caused by incorrect settings or operation on your part.
You understand and agree that you may not use Space View to scan, upload, create, share or disseminate information that:
(1) opposes the fundamental principles established by the Constitution of the People's Republic of China;
(2) endangers national security, discloses state secrets, subverts state power or undermines national unity;
(3) harms the honour or interests of the state;
(4) distorts, denigrates, profanes or denies the deeds and spirit of heroes and martyrs, or infringes their name, likeness, reputation or honour by insult, defamation or other means;
(5) promotes terrorism or extremism, or incites terrorist or extremist activity;
(6) incites ethnic hatred or discrimination, or undermines ethnic unity;
(7) undermines national religious policy, or promotes cults or feudal superstition;
(8) spreads rumours and disrupts economic or social order;
(9) disseminates obscenity, pornography, gambling, violence, murder or terror, or abets crime;
(10) insults or defames others, or infringes their reputation, privacy or other lawful rights and interests;
(11) is otherwise prohibited by laws or administrative regulations.
Where the Developer judges, at its sole discretion, that there may be harm to national security, public safety, the public interest, or the lawful rights and interests of the Developer or a third party, it may without notice restrict, freeze or delete your account, suspend or terminate some or all services under these Terms and delete your data, without liability to you. Such circumstances include, but are not limited to:
(1) the information you provided to register is not true, complete or accurate, including registering with another person's identity documents;
(2) transferring, selling, renting, lending or sharing your account with others;
(3) stealing, unlawfully accessing or misusing other users' accounts or the information in them;
(4) removing copyright information from our products, or reverse-engineering, disassembling or decompiling them, or otherwise attempting to discover the source code;
(5) commercially copying, altering, modifying or hooking into our products, creating derivative works or products, or using plug-ins, cheats or unauthorised tools to access, interfere with or affect our products or services;
(6) restricting, preventing or otherwise interfering with others' use of Space View, or disrupting normal network operation — for example by publishing or transmitting information or software containing worms, viruses or other harmful functions, or generating traffic at levels that impede others from using, sending or retrieving information;
(7) accessing or attempting to access our products or services by web crawler or other automated means, or in breach of the robots.txt or similar file in our products or services;
(8) unauthorised commercial use, renting, lending, copying, modification, linking, reproduction, compilation, publication or mirroring of the information and content in our products or services;
(9) any operation carried out in bad faith, anything that may damage ratings or reviews of our products or services, and anything that may affect their integrity or accuracy;
(10) infringing or potentially infringing the intellectual property, personal information, privacy or other lawful rights and interests of the Developer or any third party;
(11) any other conduct in breach of the law or these Terms.
You are responsible for any content you send or upload through Space View (including text, images, comments and other information), whether transmitted publicly or privately. You warrant that you have the authorisation necessary to upload it and that it does not infringe the intellectual property, personal information, privacy or other lawful rights and interests of others. If your conduct causes the Developer loss (including damages and legal fees), you agree to indemnify that loss in full. The Developer reserves the right to review, block or delete content, or to terminate the service, as permitted by law.
If, in using Space View, you breach the law or any provision of these Terms and thereby cause loss to the Developer, other users or any third party, you bear full responsibility and the Developer bears none.
5. Purchases and Top-Ups
Some of our products and services are provided for a fee and require purchase or top-up before use. Before placing an order, please check the membership type, service name, price and quantity carefully.
When you submit an order and successfully pay the corresponding amount, the contract of sale between you and the Developer for that product or service is formed and takes effect. Before it takes effect, either you or the Developer may cancel the order. Please note that formation of the contract is a precondition to the Developer providing membership benefits.
The Developer may amend the pricing and payment methods of paid services as required. Prices for products and services offered online may change at any time, and the Developer does not offer price protection or refunds in respect of price reductions or promotions.
Although the Developer takes all reasonable care to ensure that displayed prices are accurate, system faults, human error and other factors may cause a price to be displayed incorrectly. Where such an anomaly makes continued performance of the contract manifestly unfair, we may, after agreement with you, rescind the contract and refund the amount you have paid.

Purchases on iOS. Membership sold through the iOS app is an auto-renewing subscription processed by Apple's In-App Purchase system. The subscription renews automatically at the price shown at the time of purchase unless it is cancelled at least 24 hours before the end of the current period. You can view, manage and cancel it in Settings → Apple Account → Subscriptions on your device; deleting the app does not cancel the subscription. Where a free trial is offered, it applies once per Apple Account across the subscription group; if you have already used a trial in that group, billing begins immediately. Refunds for purchases made through the App Store are handled by Apple in accordance with Apple's terms.
6. Membership Service Rules
1. About the service
1.1 All services provided to members are for use by members within Space View only. Any attempt to separate the service content from the Space View platform by unlawful means, such as malicious cracking, falls outside the services agreed in these Terms. The person responsible bears all resulting legal consequences, and Space View will pursue their legal liability.
1.2 When a member uses any individual service within Space View, that use is deemed acceptance of the terms of that service and of the notices issued by Space View in connection with it. You agree and accept that Space View may provide different features in the Mini Program and in the app. After becoming a member you are free not to accept the service and may contact support to cancel it, but membership fees are not refunded.
1.3 You understand and agree that membership fees may be collected on our behalf by a payment operator, and that paying in this way carries a degree of commercial risk — including the risk that a wrongdoer uses your account or bank card for unlawful activity, causing you financial loss. You are responsible for pursuing the infringing party and bear the consequences if you are unable to do so.
1.4 Space View determines the pricing and payment methods for its paid membership services. You understand and agree that different pricing and payment methods may apply to different services, and that different pricing and payment methods may apply at different stages of a service. Space View publishes pricing, payment methods, purchase methods and other pricing information prominently on the relevant pages.
1.5 You are responsible for keeping your account, account information and password safe and for using and maintaining them properly, and for taking the necessary and effective measures to keep them confidential. Space View bears no liability where a password is disclosed for reasons not attributable to Space View, or where loss results from your own custody, use or maintenance.
1.6 Space View is not liable for loss caused by the acts or omissions of third parties, including payment services, network access services and infringement by any third party.
2. How to become a member
2.1 Before becoming a member you must register as a Space View user with true and accurate information. If the information provided is not true and valid, Space View may decline the application or revoke membership without compensation or refund. If a member's details change, they should be updated promptly; otherwise the member bears responsibility for any resulting inability to exercise membership rights fully, and Space View may revoke membership without refund or compensation of any kind.
2.2 You may become a member through any existing or future channel, including online banking, mobile payment and third-party payment. When using a particular method, you must read and accept the applicable service terms and instructions. Space View states here that any unauthorised sale of Space View membership is unlawful and Space View reserves the right to pursue legal liability.
2.3 After becoming a member you are free not to accept the service and may contact support to cancel it, but membership fees are not refunded.
2.4 Ownership of a Space View membership account rests with Space View; the member has a limited right of use.
2.5 Space View provides only the spaceflight launch information service. The equipment needed to use related network services (personal computers, mobile phones and other devices used to access the internet or mobile networks) and the associated costs (telephone and data charges) are borne by the member.
3. Membership services and account enquiries
3.1 Once you become a member you are deemed to accept the price stated for that service, and the service takes effect immediately.
3.2 The standard for value-added membership services is the detailed pricing published on the Space View platform.
3.3 You can check your account details free of charge in the membership centre, including the services activated, the service period and your purchase records.
4. Members' rights and restrictions
4.1 The advanced features provided with membership have a fixed service period; by becoming a member you are deemed to accept that period.
4.2 Membership is for use by the registered account only. It cannot be moved between Space View accounts during the membership period and may not be given away, lent, transferred or sold. Otherwise Space View may cancel the membership of both the transferring and receiving accounts without notice, and the member bears the resulting loss.
4.3 An account may be signed in on only one device of the same type at a time (for example, signing in on a computer limits you to one computer at a time, though you may also be signed in on a phone); otherwise you may be signed out, and we bear no liability. The user bears any loss arising from use beyond this scope, and Space View reserves the right to pursue legal liability.
4.4 If a member's conduct persistently breaches these Terms or applicable law, or if Space View considers that the conduct harms the reputation or interests of Space View or others, Space View may cancel the membership without compensation.
4.5 Members may not obtain or purchase membership by unlawful means such as theft or exploitation of system vulnerabilities, or from websites selling Space View membership without authorisation; otherwise Space View may cancel the membership. The member bears the resulting consequences and Space View bears no liability.
4.6 Members may not use nicknames or post comments that are unlawful, obscene, insulting or personally abusive. Where this is found, Space View may cancel the membership without compensation or refund.
4.7 We welcome your feedback on our services. Unless expressly stated otherwise, any feedback you send is treated as non-confidential; you agree that we may decide whether to publish it, you grant us the right to use it free of charge, and we may modify, adapt, redesign or otherwise change it as required. If you have any comment or suggestion about our services or these Terms, contact us at kefu@bincare.cn and we will help as promptly as we can.
7. Storage and Synchronisation of Information
You understand and agree that your preferences, saved launches and other personal data are stored on our servers and may be cached on your device, occupying storage space there.
You should decide, according to your needs, whether to set a password to protect your information when using the service.
When you use Space View while signed in, your saved launches, follows and reminder settings are synchronised automatically between your device and our servers. If you temporarily use the service on a device that is not your own, please sign out promptly and adjust your settings as necessary so as not to disclose personal information belonging to you or others.
Although the Developer takes the necessary measures to store and protect your data as required by law, we recommend that you back up important data yourself, by screenshot or otherwise. We cannot be responsible for data that was not successfully stored or that you deleted yourself.
The launch information shown in Space View is updated regularly and we do our best to keep it accurate and current. Because of the update frequency of our data sources and changes to launch plans, the information shown may be delayed or differ from the latest position; please treat the official announcement as authoritative.
8. Account Deletion
The Developer may delete your account where:
(1) your conduct breaches the law or these Terms;
(2) it is required by law or by a competent state authority;
(3) you have not signed in for more than nine consecutive months since registering, and your account has no balance and no unexpired services or benefits.
If you apply to delete your account, the Developer will approve the deletion where:
(1) the account is in normal standing, is not involved in any dispute (including complaints made by or against you) and is not subject to restrictions imposed by a competent authority;
(2) there are no incomplete transactions in the account;
(3) there are no other outstanding rights or obligations in the account (that is, no balance and no unexpired services or benefits), or you confirm that you voluntarily waive them;
(4) no other circumstance affecting deletion applies.
To delete your account, use "Mine → Settings → Account Management → Delete Account" in the app. We will process the request within fifteen working days. For enquiries or assistance with account deletion, email kefu@bincare.cn.
If, during deletion, your account becomes involved in a dispute — including a complaint, report, litigation, arbitration or investigation by a competent authority — the Developer may suspend or terminate the deletion process without needing your further consent.
You fully understand and agree that once your account is deleted you can no longer use the Developer's services and no longer hold the rights attached to the account, which will inevitably make it harder to pursue after-sales claims. Once deletion is complete, the content and data associated with the account are deleted or anonymised and cannot be recovered. Please consider carefully before proceeding.
You bear any inconvenience or adverse consequence arising from deleting your account.
9. Data Protection
The Developer takes the protection of user information seriously. The Space View Privacy Policy sets out how we collect, use, store, share and protect your information; please refer to it for details.
10. Assumption of Risk
The Developer will use the technology available to it to keep its services correct, continuous, timely and secure. However, we give no warranty of any kind, and accept no liability to compensate, in respect of unforeseeable and uncontrollable risks (such as computer viruses, trojans or other malicious programs, hacking, failures of equipment, systems, hardware, software or communication lines, and natural disasters), technical defects in the product, the stability of the service, or any resulting loss or damage — except as otherwise provided by law.
Our products and services may be updated from time to time and you may choose whether to accept an update. If you choose not to update, we do not guarantee that you will receive the latest service, and you bear any resulting loss.
To the extent permitted by applicable law, the Developer may at any time decide to suspend, terminate or modify the service, or to do so for particular users, without further notice.
Space View may contain links, APIs or SDKs relating to third-party platforms or applications. The Developer provides these purely for your convenience, gives no warranty in respect of them, and does not thereby recommend, endorse or authorise those third parties or their products and services. You should assess them yourself and bear the risk. When using any third-party product or service, you should understand and accept that third party's terms and rules.
You bear responsibility for any loss or liability arising from your own acts, and the Developer bears none. Circumstances in which the Developer bears no liability include:
(1) any loss or liability arising because you did not act in accordance with these Terms or any rule published by the Developer from time to time;
(2) any loss or liability arising because you did not give the Developer correct contact details and therefore did not receive a notice in time;
(3) any other loss or liability attributable to you.
11. Intellectual Property
All content used by the Developer in providing services to you — including text, images, video, charts, software, algorithms and other materials — belongs to the Developer or to the other rights holders specifically identified. Neither the Developer nor those rights holders grants you any other right in that information or content under these Terms. Without the prior written consent of the relevant rights holder, you may not publish, transmit, copy or otherwise use any or all of the information provided by the Developer to any third party, and you may not alter, obscure or remove any attribution, trade mark, copyright notice or other statement of rights.
Respecting intellectual property is your obligation. If you breach it and cause loss to the Developer or a rights holder, you are liable in damages.
12. Use by Minors
If you are a minor and wish to use Space View, please obtain your guardian's consent and use it under their guidance and supervision. Your guardian is responsible for helping you understand these Terms, the Space View Privacy Policy and other relevant documents, so that you use Space View properly.
In particular, if you are a child (under 14), your guardian should read the Space View Children's Privacy Policy carefully before you use Space View. You may use Space View only once your guardian has consented to it.
13. Notices of Infringement and Counter-Notices
In addition to these Terms, and in order to protect intellectual property and other lawful interests, any individual or organisation that believes a user has infringed their lawful rights or interests through use of the Developer's services (the "complainant") must submit a written notice of infringement to the Developer, signed by the rights holder personally or, in the case of an organisation, bearing the organisation's seal. The notice must include:
(1) the complainant's true identity and full contact details, including name, address, telephone number and email address, together with a copy of valid identification (such as an identity card or passport for an individual, or a business licence for an organisation);
(2) the specific name and network address of the allegedly infringing material;
(3) material establishing a prima facie case of infringement, including evidence that the rights holder owns the trade mark, copyright or other right that may lawfully be exercised in respect of the material;
(4) the following statement: "(i) I am the true rights holder in respect of the allegedly infringing content; (ii) I declare that the content of this notice is true and accurate; and (iii) I acknowledge that if the statements in this notice are untrue or inaccurate, I will bear the corresponding legal liability."
If the Developer removes content or links relating to you on the basis of such a notice, you may submit a written counter-notice, signed by you personally or, in the case of an organisation, bearing the organisation's seal. The counter-notice must include:
(1) your true identity and full contact details, including name, address, telephone number and email address, together with a copy of valid identification (such as an identity card or passport for an individual, or a business licence for an organisation);
(2) the specific name and network address of the material removed by the Developer;
(3) material establishing a prima facie case that there is no infringement, including evidence of ownership of the trade mark, copyright or other right that may lawfully be exercised in respect of the material;
(4) the following statement: "(i) I am the true rights holder in respect of the content complained of; (ii) I am entitled to provide or disseminate that content, and I declare that the content of this notice is true and accurate; and (iii) I acknowledge that if the statements in this notice are untrue or inaccurate, I will bear the corresponding legal liability."
We handle the information collected through the notice and counter-notice procedures in strict compliance with personal-information protection rules, use it solely for the purpose of dealing with the alleged infringement, and — except where the law provides otherwise, and having retained it for use in any possible litigation — delete it promptly once the limitation period has expired.
14. Commercial Activity
You understand and agree that we may carry out the following commercial activity within the products and services the Developer provides: sending you commercial advertising or other commercial information relating to the Developer or to third parties, through the app, the Mini Program, our website, SMS, email or other lawful means.
Please note in particular that where the information you receive relates to a third party rather than to the Developer, you should judge its accuracy for yourself and are responsible for your own judgement. Except as expressly provided by law, we bear no liability for any loss or damage you suffer as a result of the content of such information.
15. Disclaimers
The launch information shown in Space View comes from public announcements by space agencies and from third-party data services; Space View aggregates and presents it so that users can conveniently follow spaceflight activity worldwide. Because launch plans may change or be postponed for reasons of weather, technical issues and the like, Space View does not warrant that launch information is absolutely accurate or completely up to date. Users should understand the nature of spaceflight: launch times, locations and similar details are shown for reference only, and the latest official announcement of the relevant agency should be treated as authoritative.
You acknowledge that where the services provided by Space View involve data whose retrieval or use requires authorisation from a rights holder under laws, regulations or normative documents, you and the people who use your systems must obtain that authorisation before retrieving or using the data. You bear all adverse consequences of retrieving or using such information without the relevant authorisation.
You agree that we bear no legal liability for:
disclosure of your information and other consequences not attributable to Space View — for example, where you tell someone else your account and password or share your registered account with another person;
provision of your personal information by Space View as required by law or by government policy;
temporary shutdown of the software caused by hacking or virus intrusion;
any consequence of force majeure;
your inability to use Space View normally because of network conditions, communication lines, third-party websites or any other cause;
the methods of use and the exclusions set out in the various service terms and notices of Space View.
Whether to download or obtain any material through Space View is a matter for your own judgement and risk; you bear any damage to your computer system or loss of data resulting from such a download.
No advice or information you obtain from Space View or through the service, whether written or oral, constitutes any warranty beyond those expressly set out in these Terms.
Space View bears no liability to compensate for harm to any third party caused by your improper use of the service or by decisions you make on the basis of information in Space View. You must fully indemnify Space View or the third party for such harm.
The content of Space View and the services it provides carry no express or implied representation, warranty or condition, including any express or implied representation, warranty or condition of merchantability or fitness for a particular purpose, or that use will be uninterrupted or error-free.
Space View does not represent or warrant that the service, or content downloadable from it, is free of computer viruses or similar unwanted or destructive features.
Space View does not warrant that the service will meet a user's requirements, and is not responsible for the deletion of page content or for failures to store it.
Where Space View has clearly announced a change to how the service operates and set out what you need to do, you bear all consequences of not acting accordingly.
You acknowledge that use of the service involves internet and telecommunications value-added services and may be affected by unstable factors at every link in the chain. The service is therefore subject to interruption, or may fail to meet your requirements, because of adjustments by the competent industry authorities or telecommunications operators, the discontinuation of a third-party data source, system instability, your location, your device being switched off, or any other technical, network or communication-line cause. You bear these risks and Space View gives no warranty. Space View bears no liability where you are consequently unable to send, upload, receive or read messages, where messages are sent or received incorrectly, or where other communication conditions cannot be met.
You acknowledge that using the service carries the risk of encountering anonymous or impersonated material from other people that is threatening, defamatory, objectionable or unlawful, or that infringes others' rights (including intellectual property). You bear these risks, and no liability is accepted for direct, indirect, incidental or punitive damages resulting from improper or unlawful use of the service by users.
Given that the Space View platform aggregates and presents public data, and that all information on it comes from public spaceflight data sources — for the accuracy of which the source is responsible — the information is presented for the purpose of conveying spaceflight news, and does not mean that Space View accepts responsibility for whether a launch succeeds or for how it is carried out.
You expressly agree that you bear the entire risk of using the service, and that you bear all consequences arising from your use of it; Space View bears no liability to you.
16. About Space View
Space View is a product for looking up spaceflight launch information worldwide. By aggregating public launch data, Space View provides a convenient way to look up the global rocket launch schedule, launch mission details and information about space agencies, helping enthusiasts keep up with spaceflight activity around the world.
17. Miscellaneous
If any provision of these Terms is or becomes wholly or partly invalid or unenforceable for any reason, the remaining provisions remain valid and binding, and you and the Developer will each use your best efforts to give effect to the intention behind the affected provision.
The validity, interpretation, amendment, performance and dispute resolution of these Terms are governed by the laws of the People's Republic of China (for the purposes of these Terms, excluding the laws of the Hong Kong SAR, the Macao SAR and Taiwan).
The parties will endeavour to resolve any dispute arising out of these Terms amicably. Failing agreement, either party may bring proceedings before the competent People's Court at the Developer's location, Nanshan District, Shenzhen.
